Port Delivers is a local food ordering and delivery platform connecting customers with participating restaurants in Port Douglas and surrounding areas.

Port Delivers facilitates orders, coordinates delivery, and processes payments but does not prepare food.

Food is prepared by independent restaurant partners.

2. Service Area

Port Delivers currently delivers to:

• Port Douglas
• Craiglie

Delivery areas may expand or change over time.

Orders outside the service area may not be accepted.

3. Orders

When placing an order through the Port Delivers platform you agree that:

the order is accurate and complete

the delivery address is correct

contact details provided are valid

Once an order has been confirmed by the restaurant, it begins preparation and may not be able to be changed or cancelled.

4. Restaurant Responsibilities

All food is prepared by partner restaurants.

Restaurants are responsible for:

food preparation

ingredient quality

allergen information

menu accuracy

packaging of orders

Port Delivers is not responsible for food preparation or ingredients used.

Customers with allergies should contact the restaurant directly before ordering.

5. Delivery

Port Delivers coordinates local drivers to collect orders from restaurants and deliver them to customers.

Delivery times are estimates and may vary due to:

restaurant preparation times

weather conditions

traffic

high order volumes

Port Delivers will make reasonable efforts to deliver orders promptly but cannot guarantee exact delivery times.

6. Delivery Fees

A delivery fee applies to all orders.

Delivery fees may vary depending on the delivery location and may change from time to time.

The delivery fee is clearly displayed at checkout before payment is completed.

7. Minimum Order Values

Certain restaurants may apply minimum order values for delivery.

Minimum order requirements will be displayed during the ordering process.

8. Payments

All orders must be paid for at the time of checkout using the payment methods available on the platform.

Payments are processed securely through third-party payment providers.

Port Delivers does not store full credit card details.

9. Refunds and Order Issues

If there is an issue with your order, please contact us as soon as possible.

Refunds or credits may be considered in circumstances such as:

incorrect items delivered

missing items

delivery not completed

Issues relating to food quality or preparation will generally be referred to the restaurant responsible for preparing the meal.

Refund decisions are made at the discretion of Port Delivers after reviewing the circumstances.

10. Customer Responsibilities

Customers agree to:

provide accurate delivery details

ensure someone is available to receive the order

answer phone calls if the driver needs assistance locating the address

If a delivery cannot be completed due to incorrect information or inability to contact the customer, the order may be considered fulfilled and may not be refunded.

11. Limitation of Liability

To the maximum extent permitted by law, Port Delivers is not liable for:

food preparation issues

allergen reactions

restaurant menu inaccuracies

delays caused by restaurants or external factors

Our liability is limited to the value of the order where required by applicable law.

12. Website Use

You agree not to:

misuse the website or ordering system

attempt to gain unauthorised access to systems

interfere with the operation of the platform

Port Delivers reserves the right to restrict access or cancel orders where misuse is suspected.

13. Changes to the Service

Port Delivers may modify or discontinue parts of the service, delivery areas, or operating hours at any time.
